است كه سير تحول ديدگاه‏ها در زمينه خسارت‏هاى زائد بر ديه كه يكى از مهمترين مسائل مطرح در زمينه اجراى احكام ديه است مورد بررسى قرار گيرد، بدان اميد، كه اين بررسى مقدمه‏اى براى چاره‏جويى اساسى در اين زمينه باشد. با حاكميت نظام اسلامى درايران، قوانين و مقررات حاكم بر «جرايم عليه تماميت جسمانى اشخاص‏» (صدمات بدنى) نيز چون بسيارى قوانين ديگر، دست‏خوش تغيير و دگرگونى اساسى گرديد. و مقررات قصاص و ديات جايگزين مقررات پيشين شدند. پيش از آن‏كه به بررسى موضوع ديات و خسارت‏هاى ناشى از صدمات بدنى بپردازيم لازم است كه نگرشى اجمالى داشته باشيم به مهمترين قوانينى كه تا پيش از تدوين و اجراى مقررات ياد شده در موارد بروز صدمات بدنى خواه عمدى و خواه غير عمدى مورد استناد دادگاه‏ها قرار مى‏گرفته و براساس آن‏ها به صدور حكم مجازات و ياجبران ضرر و زيان‏ناشى از صدمات بدنى مى‏پرداخته‏اند. الف: قوانين حاكم بر صدمات بدنى تا پيش از استقرار نظام اسلامى مهمترين قوانينى كه در اين زمينه قابل اشاره مى‏باشند عبارتند از: 1.قانون مجازات عمومى; 2. قانون مسؤوليت مدنى. 1. قانون مجازات عمومى قانون مجازات عمومى و متمم آن داراى 288 ماده بود، كه از ماده 1 تا 169 آن ابتدا در تاريخ 22 دى‏ماه 1304 به تصويب رسيد ولى در تاريخ 7 خرداد ماه 1352 مواد 1 تا 59 آن مورد بازنگرى و اصلاح اساسى قرار گرفت. مواد 170 تا 280 قانون ياد شده در تاريخ 7 بهمن 1304 و مواد 281 تا 288 آن نيز در تاريخ 27 تير ماه 1310 به تصويب رسيد. 2. قانون مسؤوليت مدنى قانون مزبور كه در 17 ارديبهشت ماه 1339 به تصويب رسيده بود، به طور عمده از قانون تعهدات كشور سوئيس و قانون مدنى كشور آلمان اقتباس گشته و مشتمل بر 16 ماده بود. به هنگامى كه لايحه مربوط به اين قانون مراحل تصويب خود را مى‏گذرانيد، معاون وقت وزارت دادگسترى طى يك سخنرانى در تالار اجتماعات اين وزارتخانه اعلام داشته بود: علت اساسى تهيه اين لايحه اين بود كه قوانين موضوعه آن طورى كه بايد و شايد و به اقتضاى اوضاع اقتصادى و اجتماعى فعلى، كافى براى جبران خسارت وارد به افراد نبود. (3) بدين‏سان مى‏توان گفت كه تدوين كنندگان قانون مسؤوليت مدنى، بر آن بوده‏اند كه مقررات قانون مدنى مصوب 1307 درزمينه «ضمان قهرى‏» را تكميل كنند.
