هستند آن را دارا مىباشند که به آن اهليت نيز مىگويند که در قانون مدنى موادى در خصوص اهليت وجود دارد همچنانکه ماده ۹۵۶ قانون مدنى مىگويد: اهليت براى دارا بودن حقوق با زنده متولد شدن انسان شروع و با مرگ او تمام مىگردد و در ماده ۹۵۷ در مورد اهليت حمل چنين مىگويد: حمل از حقوق مدنى متمتع مىگردد مشروط بر اينکه زنده متولد شود بنابراين لازمه بهوجود آمدن، زندگى کردن، داشتن حقوق و تکاليفى است که قانون آن را به رسميّت شناخته و اعمال و اجراء حقوق مزبور را در قانون مدنى به داشتن اهليت مدنى يعنى اهليت تمتع و استيفاء تعبير نمودهاند که اقتضاء دارد درباره هر يک توضيحات مختصرى داده شود. <span
