روي آنها مشاهده نمودهاند و شايد اولين سؤالي كه به ذهنشان خطور كرده اين باشد كه اين جملات موجد حقي راي ناشر يا مؤلف ميشود. به هر حال، هر كس دستكم يك كتاب نوشته يا يك محصول فرهنگي توليد كرده باشد باتوجه به سرمايهاي كه در اين راه خرج كرده، اعم از سرمايههاي مادي، معنوي، فكري و اعتباري، خود را نسبت به سود حاصل از آن و توليد مجدّد آن محق ميداند. اكنون يك بحث اين است كه اين حق عرفي مبانيي شرعي يا قانوني توجه به اينكه هنوز مباني فقهي اين بحث به خوبي تبيين نشده است اين مقاله به مباني شرعي و فقهي آن نميپردازد و صرفاً به بررسي تطبيقي حقوق مالكيت فكري (معنوي) در حقوق ايران و سازمان جهاني تجارت ميپردازد. ايران به زودي به طور كامل، به اين سازمان خواهد پيوست و الحاق كامل ايران به اين سازمان لازمهاش به وجود آمدن بسترهاي لازم در حقوق ايران است. با بررسي تطبيقي بين اين دو (حقوق ايران و سازمان جهاني تجارت)
