مشکل نباشد اما در حواله بر مدیون، مشکل است زیرا محال علیه که دین محیل را بر ذمه دارد باید بموجب این نظریه دین محیل به محتال را هم بر ذمه بگیرد! و چون اجتماع دو دین در ذمه او خلاف اصول است پس باید دین نهاده اند و اکثریت هم دارند در کنار این اندیشه، مبنای عقد حواله را معاوضه و حتی بیع میدانند و نام آن را «بیع دین به دین» نهاده اند. <span
