اسلامي – تعزيرات از مواد 697 تا 700 تحت عنوان افترائ و توهين و هتك حرمت ذكر شده است . ولي همه‌ي مواردي را كه بنابر معناي عرفي ، و ضابطه‌ي حقوقي و علمي در حقوق جزاي اسلامي ، بتوان به عنوان « افتراء و توهين و هتك حرمت) شناخت ،‌ در بر نمي ‌گيرد در نتيجه اين قسمت از قانون فاقد جامعيتي است كه عنوان آن اقتضاء مي‌كند زيرا در پاره‌اي ديگر از قانون مجازات اسلامي مواردي ديگر بيان شده است كه مي تواند تحت اين عنوان قرار گيرد . از جمله مواد 139 تا 164 ق . م اسلامي ، قذف كه نسبت دادن زنا يا لواط به ديگري است ، نوعي افتراء تلقي مي‌شود .<span style='font-family:"Arial","sans-serif";
