فردى ممكن است نيازمند آن باشد. چه بسيار ديده شده است اشخاص ديون و طلبهاى خويش را نمى‌توانند در زمان حيات خود پرداخت و يا مطالبه نمايند و يا تمايل به انجام كارى داشته‌اند و يا قسمتى از آن را انجام و قسمتى را ناتمام گذاشته‌اند، ولى اجل مجال اتمام و يا انجام آن كار را ممكن نساخته است. در بسيارى از موارد و به طور مثال مواردى كه مطرح گرديد وصيت عمل حقوقى مفيدى است كه موجب رضايت و آرامش خاطر افراد در minor-latin;mso-bidi-font-family:Arial;mso-bidi-theme-font:minor-bidi' lang='FA'> به جهت اهميت وصيت در زندگى اجتماعى افراد در فقه اسلامى و حقوق مدنى اين مبحث از اهميت وافرى برخوردار مي‌باشد و همواره مباحث وصيت موردتوجه حقوقدانان و فقهاى اسلامى بوده است. شكى نيست كه فلسفه وجودى حقوق و بالاخص حقوق مدنى تنظيم و برقرارى عدالت در مطالبات و ديون و اساساً روابط حقوقى افراد است لذا اقتضاى اين امر اين است كه در مورد مراودات و معاملات حقوقى اشخاص بعد از حيات دنيوى نيز قواعد و مقرراتى حاكم باشد كه موجب حمايت از حقوق بازماندگان او باشد. <span style='font-family:"Arial","sans-serif";
